DA feriegaranti

DA Feriegaranti administers the holiday guarantee on behalf of a number of DA’s member organisations.

The following employers’ organisations are covered:

  • Dansk Industri (The Confederation of Danish Industry)
  • Dansk Erhverv (The Danish Chamber of Commerce)
  • Dansk Byggeri (The Danish Construction Association)
  • TEKNIQ
  • SAMA (only ABAF, Dansk Maskinhandlerforening Dansk Maskinhandlerforening (Association of Danish Agricultural Machinery Dealers), Glarmesterlauget i Danmark (Master Glaziers’ Guild in Denmark and SKAD)
  • Danske Mediers Arbejdsgiverforening (Danish Association of Media Employers)
  • Grakom Arbejdsgivere (Grakom Employers)
  • Asfaltindustrien (The Danish Asphalt Pavement Industry)/Drivkraft Danmark (Driving Force Denmark)
  • Danske Malermestre (Danish Association of Master Painters)
  • Dansk Mode & Textil (Danish Fashion and Textile)

The following applies if you are an employee or represent an employee that has been employed in a company in liquidation or in bankruptcy.

The holiday guarantee covers you, if:

  • Your employer was a member of one of the above employers’ organisations during the period in which the holiday pay was accrued, and
  • You have been employed under a collective agreement.

If you have not been employed under a collective agreement, you must direct your claim to Lønmodtagernes Garantifond.

DA Feriegaranti is not automatically notified of companies that have gone into liquidation or bankruptcy etc. Likewise, we are not notified of those employees who may have remaining holiday pay, SH or optional payments.

Therefore, for the issuance and payment of various receivables you must submit the following:

  • The completed and signed Declaration of Transfer - available in EnglishGerman and Polish.
  • Copy of employment contract – alternatively, a job description and description of your work tasks and terms and conditions of employment.
  • Copy of your last wage slip for the qualifying year, if it shows a year-to-date figure for the accrued holiday pay. If not, all wage slips for the qualifying year must be submitted.
  • A printout of the holiday pay information from Borger.dk showing the amount saved.
  • Copy of LG’s Payment Specification if LG has paid out missing wages.

DA Feriegaranti's processing of your personal information:

DA Feriegaranti processes your information by agreement with the aforementioned associated member organisations on the basis of the relevant collective agreement in order to be able to pay out your claim for holiday pay, SH or Optional Payment. DA Feriegaranti has responsibility for the data processed in DA Feriegaranti. DA Feriegaranti has to process your information in order to be able to fulfil your legal entitlement to holiday pay, SH or Optional Payment in accordance with the agreement in question. Therefore, the processing is legal, cf. primarily Article 6, item 1, schedule c, e and f of the General Data Protection Regulation (GDPR), and also Section 12 of the Danish Data Protection Act. This also applies to the processing of your CPR number, cf. the Danish Data Protection Act, Section 11, item 2, no. 4, cf. Section 7, item 2.

DA Feriegaranti will store your information for 5 years from the end of the financial year in which your claim has been paid out. DA Feriegaranti will exchange your information with the Lønmodtagernes Garantifond (Employee Benefits Guarantee Fund) and Feriepengeinfo (Holiday pay Info) and the member organisation in question. DA will pass on your information to the member organisation in question in the event of any dispute relating to your claim and if, for example, your claim has to be dealt with by a court. You are entitled to ask DA Feriegaranti for access to the information about you that DA Feriegaranti is processing. As a registered employee, you also have a number of other rights. You have the right to ask DA Feriegaranti to rectify, delete or restrict the processing of your information, as well as, in certain cases, the right to obtain a copy of the information. Finally, you have the right to object to the way in which DA Feriegaranti is processing your information. If you would like to make use of your rights, you can contact DA at da@da.dk.
